Terms and Conditions

Please review the terms and conditions relating to this reservation.

The Contract:  Bookings between Mike and Elaine Thomas, (hereinafter called the owners) and the person making the bookings (hereinafter called the client) are valid after (a) the booking form has been completed, signed and has been received by the Owners or the client has agreed to the conditions via the website or online booking system; (b) the appropriate deposit has been paid to the Owners; and (c) the booking has been confirmed to the Client by the Owners in writing.

The Agreement:  By accepting these conditions the client warrants that he/she is authorised to agree to them on behalf of all other persons named on the booking form, including those substituted or added by subsequent agreed amendment of the booking. Renter must be 21 years old to Reserve the property

Prices:  All prices are to the best of our ability correct at the time of issue / quotation.  The Owners reserves the right to amend prices during the course of the selling season.  Final prices will be confirmed on the invoice and will be honoured unless the Owners cannot accept the booking at the price quoted.

Payments: Final payment is due 6 weeks prior to travel date. If the Client does not pay the balance due at the prescribed time the Owners reserves the right to cancel the booking, this action will be taken 3 weeks prior to arrival date.  In this event the deposit will be forfeited and it may not be possible to reinstate the reservation. A 7 day courtesy hold is available without obligation. However, once you have provided your deposit payment information and are given written confirmation your reservation is guaranteed and subject to all cancellation fees.

Security Deposit & Damage: A Security Deposit on rentals is used to cover breakages, damages or any extra cleaning required.  This does not include any additional costs related to cots, high chairs, pool heating, BBQ’s or any other product/service rented locally through the management company. Telephone/Internet call charges are not covered through the security deposit scheme. We operate a simple security deposit scheme for each villa rental.  A Refundable security deposit of £150-£200 ($200-$300) per booking will be charged. This will be returned in full within 2 weeks once it has been established, through the management company, that no damage has been caused to the property. If damage has been done during the rental period, the cost of rectifying the damage will be deducted from the security deposit, with any monies being returned to the client within 3 weeks of the end of the rental period. 

Cancellations & Refunds: You, or any member of your party, may cancel your booking at any time.  Written notification from the person who made the booking must be received at our home address.  Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges up to the maximum shown below.

Period before departure within which written cancellation is received:

More than 56 days:  Loss of deposit
42-55 days: 30% or deposit if greater
29-41 days: 50%
22-28 days: 75%
8-21 days: 90%
7 days or less: 100%

Note: if the reason for cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim these charges. The full insurance premium is retained by the insurer in the event of cancellation.

Amendments and alterations made by the Client: The Owners will always endeavour to meet requests for changes to existing bookings. 

Check-In / Checkout: Upon receipt of your payment, your Reservation Confirmation will be mailed to you.

Check-In is from 4:00 PM : Details will be provided with your travel documentation prior to rental start date.

Check-Out is normally 10:00 AM.: Any individual variations on these normal times will be advised to the Client locally.  Any extensions on these times may incur additional charges. The villa is cleaned and inspected upon your departure, however it should be left in a reasonable state of cleanliness otherwise additional fees may be charged.

Villa  Equipment: Bed linens and towels are provided, except for beach towels. Kitchen utensils and a starter supply of soap and paper products are made available for all rentals. You will need to bring or purchase additional supplies. Maintenance problems in the villa will be handled in a timely and professional manner. The rental rate will not be adjusted due to any malfunction of equipment, which includes TV’s, DVD’s, air conditioning units, hot water heaters, stoves, refrigerators, door locks, etc.

Maximum Occupancy: The maximum occupancy of the villa is 10 persons. Take note of the maximum number of guests allowed in the villa before making your reservation. This policy is strictly enforced. Only the numbers of persons named on the booking form are allowed to stay at the property. The signatory must be a member of the party occupying the property and must be 21 years of age or older. We reserve the right to refuse admittance if this condition is not observed. If at any time we have to change your accommodation before check in due to reasons beyond our control, you will be notified in writing with information of your new accommodation. No compensation will be paid in the event that we have to change your accommodation or in the event that you decide to cancel your booking because you are not satisfied with the alternative offered.

Gatherings
The property is located in a residential area and is rented for personal vacation use only. Parties and other large gatherings are not allowed.

No Smoking
The villa is strictly Non-Smoking!  Smoking will only be permitted outside unless otherwise specified.

Pet Policy
No pets allowed.

Additional Provisions
The property management may enter the premises at any time in the event of emergency, but will use its best efforts to give 24-hour notice for normal maintenance or sales inspections.

Exclusions
The Owners will not be liable for any loss or delay to or cancellation of the Clients holiday due to industrial disputes, riots, threat of hostilities, political unrest, natural disasters, aircraft grounding, closure of airports or ports, weather conditions or any other circumstances beyond their control.

Poolside
All persons use the pool and surrounding area entirely at their own risk.  At all times children must be supervised by parents or other responsible adults when using the pool. During your stay, Kingdom State Villas Management Inc., its representative(s), the owners, or owner’s agents do not accept any liability what so ever for death, personal injury, accidents, loss or damage to persons or personal effects however caused. The property has a swimming pool, and the owners or management do not accept responsibility in the event of injury or death caused as a result of the use of the pool. There is a safety fence for your protection. Do not remove it. All caution must be taken around wet areas. Do not run around pool or indulge in horseplay. Water is dangerous! If a pool cover is fitted, the guest must remove (by rolling up on the roller provided) the pool cover before using the swimming pool.

Villa Care
The client is responsible for the property and will be expected to take reasonable care of it. At the end of the rental period all kitchenware must be clean and the property must be left in a reasonable condition for the cleaners. Please note most homes have a non-smoking policy. You must take special care not to block the waste drainage system or call out the local sherriff through careless use of the alarm system. Charges will apply if these rules are not followed.

Complaints
Any complaints in resort should be brought to the immediate attention of the management company (contact number in accommodation) who will make every effort to resolve the problem.  It is considered reasonable to allow the management company 48 hours to rectify most problems with the property. Failure to inform the management company or the Owners within the given time frames MAY affect compensation.   The Owners and Management Company will endeavour to resolve any complaints as they arise.  However, where complaints have been unsuccessfully resolved in resort the Client should write to the Owners within 28 days of return.  Upon receipt of the Client’s letter an acknowledgement will be sent within 5 days and advised of the solution or progress within 28 days.  In situations where the Client has not contacted the management Owners or the Owners whilst in resort no liability can be accepted by the Owners with the exception of appropriate and reasonable additional costs incurred. 

Insurance, Passports and Visas
The Client is responsible for ensuring sufficient travel insurance is secured as of the time of booking.  The Owners will accept no liability for Clients travelling without suitable travel insurance.  All passengers (including children who must now have their own passport) must have a full valid passport with at least 6 months validity from the date of exit from the USA.  For clients who do not hold a British passport or have any queries relating to their visa requirements it is STRONGLY recommended to contact the American Embassy in London. 

Jurisdiction
This contract is subject to and shall be construed solely in accordance with the laws of England and all parties herby submit to the exclusive jurisdiction of English Courts.

Refusal
The Owners reserves the right to refuse any booking.

FORCE MAJEURE: The owners or management do not accept any responsibility or liability occasioned by strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, industrial disputes, fire, flood, technical problems to transport, aircraft grounding, closure of airports or ports, weather conditions or any other event beyond our control.

ARRIVAL / DEPARTURE: The property is available after 4pm on the day of arrival and must be vacated by 11am on the day of departure. An early arrival / late check out may be pre arranged and accommodated where possible. Any unauthorized late check out is subject to a fee of $120.00

IMPORTANT ADDITIONAL INFORMATION

The following are subject to charges:

Security alarm – if you set off the alarm and the Mgt or Sheriff Dept are called out, a fee of $65 is payable

Pool Fence – if the pool fence is taken down and not replaced a fee of $35 is payable

Toilet – if the Mgt is called out to unblock toilet, a fee of $65 is payable

Internal door locks - if the Mgt is called out to unlock a door a fee of $35 is payable

Pool screen doors – if these are locked and the Mgt is called to open up, a fee of $35 is payable

Pool Heating - the heating will be turned on 2 days prior to your arrival by management company. All pool heaters work by recycling air from the environment and using the air to heat the water. If the ambient temperature drops under 50 degrees farenheight, the heater will not work. The owners take no responsibility for the surrounding ambient temperature.
